November Board Meeting Minutes

Spring Pond Estates Homeowners Association
Monthly Board Meeting

November 11, 2019


President Gerry Rainforth called the meeting to order at 6:20 PM with all Board Members in attendance.

Recording Secretary El Rotsko asked if there were any questions or revisions regarding the October minutes, including the three-item addendum.  A motion was made to accept the minutes by Sally LeMon and seconded by Sally Hudgins. Motion passed (Minutes on file).

Treasurer Strazzere reported the expenses for the month of October were significantly under budget partially due to the decrease in lawn, ground and tree services. He also noted that Patten Lawn Care Services would be increasing their plowing fees an additional $5.00 for any account older than 2018.
A motion was made by Sally Hudgins and seconded by Jane Laughton to accept the Treasurer’s Report. Motion passed (Report on file).

Architecture Committee Chairperson Sally LeMon noted the homeowners located at 6 Ruch Lane have begun scheduling construction regarding the expansion of their driveway.

By-Laws & Covenants Committee Chairperson Sally Hudgins reported the committee has met twice thus far and that the next meeting has been scheduled for December 1st.

Landscaping Committee Chairperson Sally LeMon reported the Fall clean-up will begin in the near future.  She also noted the Association plans to renew the annual contract with Mainely Grass for another year.

Maintenance Committee Chairperson Lee Page reported he had replaced the bulbs around the Spring Pond Estate sign. He also noted the exterior faucets at the Community Center have been shut down for the Winter season.

Plowing Committee Chairperson Jane Laughton noted the sand barrels are in the process of being delivered and to notify her if anyone else in need of one.

Social Committee member Gerry Rainforth reported on behalf of Chairperson Nancy Winograd that the Annual Holiday Party will be on December 15th with additional details to follow.

Under Old Business Sally Hudgins reported, with the Board’s approval, she would like to continue maintaining the Homeowner’s Emergency Contact List.  She noted this information would be kept in a secure location at the Community Center and that she would be willing to volunteer her time to review the list and make any necessary revisions. The Board was in full agreement.

Also, under Old Business, responsibility for maintaining the two drainage outlets on Styles Lane was discussed at our October Board Meeting.

Sally LeMon reported at this Board Meeting that the Town of York (as per our Documents) is responsible for the care of these two drains. In early Spring we will be in touch with the Department of Public Works to discuss this issue.

Under New Business Sally Hudgins noted she had been contacted by a Bayberry resident regarding some tree work that had been done in the area between Bayberry and Spring Pond Estates and that that boundary locations for each complex may have to be addressed. After some discussion it was suggested that, if in the future a specific issue does arise, the Association will contact the Registry of Deeds and review the existing records on file with the Town of York.

President Gerry Rainforth noted the monthly Board meetings will be suspended until March but added the Board would still be available to meet if need be.

October Board Meeting Minutes

Spring Pond Estates Homeowners Association
Monthly Meeting

OCTOBER 14, 2019

President Gerry Rainforth called the meeting to order at 6:30 PM with all Board members in attendance.

Recording Secretary El Rotsko presented a three-item addendum to the September 12th minutes. A motion to accept the minutes and addendums was made by Sally Hudgins and seconded by Joe Strazzere. Motion passed (Minutes and Addendums on file).

Treasurer Joe Strazzere reported the expenses for September were below budget and that the landscaping expense was $1100 below budget as well. He also noted that the York Water District has announced the rates for next year will be increased 5.9%, effective January 1, 2020.  A motion to accept the Treasurer’s report was made by Sally Hudgins, seconded by Sally LeMon. Motion passed (Report on file).

Architecture Committee Chairperson Sally LeMon submitted a request to the Board from 6 Ruch Lane for permission to increase the width of their existing driveway. The request was passed unanimously.

By-Laws Committee Chairperson Sally Hudgins referenced a section of the By-Law Declaration pertaining to homeowner’s insurance stating any changes regarding individual policies would require a written notification to the Association. She also noted that the By-Law committee would be meeting in two weeks.

Landscaping Committee Chairperson Sally LeMon reported that Patten Lawn Care Services will be winding down for the season and that the final fall clean-up will begin once the last of the leaves have fallen.

Maintenance Committee Chairperson Lee Page reported that J&L Electric has installed an additional sensor light to enhance night time visibility along the parking lot of the Community Center. He also noted that the light bulbs at the center have been replaced with LED bulbs. Lastly, he was happy to report he had located the connection box that controlled the sensor light post along the Styles Lane entrance enabling him to make the necessary adjustments needed to resolve the lighting problem.

Long-Range Planning Committee Chairperson Joe Strazzere reported that the committee held its initial meeting on October 14th.  Jane Laughton and Bill Bannister were also in attendance at which time a list of potential projects was compiled. At the next meeting the committee plans to choose some of the higher priority projects from said list and will begin compiling estimates from the appropriate vendors (Report on file).

Under Old Business President Rainforth reported she had been in discussions with D. F. Richard concerning the heating system (air handler) located at the Community Center. She also reiterated
who is responsible for servicing the system by resubmitting a proposal that was approved by the Board on December 12, 2018 confirming it would be the responsibility of the Association to maintain the heating system located at the Community Center. (Letter on file).

She also referred to an e-mail she recently received from Beth & Diane Kaplan stating how appreciative they were regarding the fair and professional way the Board had handled their barking dog(s) issue.

Under New Business President Rainforth reported that the homeowners located at 23 Spring Pond Circle had asked about who should be responsible for repairing or replacing one of the pole supports to their porch roof in the front of their home. After some discussion the Board determined that is was the responsibility of the homeowner to make the necessary repairs.

A motion to adjourn was made by Sally Hudgins, and seconded by Sally LeMon. Meeting was adjourned at 7:10 PM.

Proscape will be draining and shutting down all irrigation systems on Thursday, October 24th, starting at 8:00 AM, and starting at 2 Spring Pond Circle.

If they need to enter your house or garage to do this, please make sure you are home, or that a neighbor can assist them.

September Board Meeting Minutes

                                                    SPEHOA MONTHLY BOARD MEETING

                                                                  SEPTEMBER 12, 2019



President Rainforth called the meeting to order at 6:30 PM with all Board members in attendance.

Recording Secretary Rotsko’s August minutes were reviewed and accepted as written with all in
favor (Minutes on File).

Treasurer Strazzere noted the landscaping expenses for the months of July and August were under budget due to the limited landscaping services performed during both months. He also reported he was able to transfer the usual $1740 into our reserve account. Motion to accept report made by Sally LeMon, seconded by Jane Laughton. Motion passed (Treasurer’s Report on File).

Architecture Committee Member Sally Hudgins suggested adding an additional volunteer to the committee and offered to canvas for perspective volunteers.

By-Law Committee Chairperson Sally Hudgins reported the By-Law Committee will be meeting on September 24th.  At that time it will be determined which by-laws can be revised and which cannot due State Mandates.

Landscaping Chairperson Sally LeMon reviewed the activities that had occurred during the month of July with some discussion regarding the emergency exit Right of Way. It was noted that it is more cost efficient not to maintain this area on a regular basis with the understanding that the exit would still be kept fully accessible for any and all emergency vehicles.

Sally LeMon also noted that it is the responsibility of the individual home owners to maintain the gardens, trees and bushes, including arborvitae(s) that are located on their properties. Responsibility for the removal of this debris was not discussed.

Joe Strazzere expressed his concern as to how our landscaping service would know which areas would not be their responsibility. Sally LeMon said she would be contacting John Patten in the near future to discuss that determination with him.

Sally LeMon also expressed her concern about the lack of notable improvement from the services performed by Mainely Grass regarding the removal of crab grass and weeds. She suggested we look into other vendors who might perform this service more successfully. Jane Laughton made a motion to research other options, seconded by Sally Hudgins. Motion passed.

Chairperson Lee Page noted he continues to monitor the street light located by the entrance of Styles Lane. He also discussed with the Board the importance of maintaining the heating system in the Community Center which also services the two units located above and that the filters should be replaced periodically.

President Rainforth reported on behalf of Social Committee Chairperson Nancy Winograd that the Labor Day Pot Luck Dinner was very successful and that great fun was had by all.

Sally LeMon noted the Sunshine Club is much appreciated and that Janice Schlapak is doing a great job.

Under New Business Sally LeMon discussed with the Board the possibility of installing a better lighting system by the side of the Community Center. Lee Page said he would research different options, such as solar lighting or installing an additional motion sensor light.

Under Old Business President Rainforth updated the Board regarding the dog barking issue. She notedthat the Kaplan family has been making a concerted effort to comply with the wishes of the Board. Members of the Board were all in agreement that these efforts appear to be working and are greatly appreciated.

Motion to adjourn was made by Sally Hudgins, seconded by Joe Strazzere.

August Board Meeting Minutes

                                                                         AUGUST 12, 2019


President Rainforth called the meeting to order at 6:30 PM. Vice President LeMon was not in attendance.

Recording Secretary Rotsko’s July minutes were accepted as written. Joe Strazzere made a motion to accept the minutes, seconded by Sally Hudgins. Motion passed (Minutes on file).

Treasurer Strazzere gave a follow-up report regarding the $2400.00 pre-payment to D. F.  Richard to cover propane usage at the Community Center noting two-thirds of the total will be reimbursed to the Association by the building’s second floor home owners. Motion to accept Treasurer’s report was made by Jane Laughton, seconded by Sally Hudgins (Treasurer’s report on file).

By-Law & Declarations Committee Chairperson Sally Hudgins suggested employing the services of an attorney who specializes in home owners’ associations rules and regulations. She explained the purpose would be to   utilize his expertise as a guideline in preparation for the upcoming By-Law Committee meeting scheduled for September.

Members of the Board agreed that this could be helpful but thought there should be further research on the subject in order to determine the amount of billing time that would be required.

The July Landscaping Committee report has been tabled until next month’s meeting.

Maintenance Committee Chairperson Page reported repairs to the cracks and damage along the complex roadway and Community Center parking lot have been repaired to the best of his ability.

President Rainforth noted she is waiting for a response from Director Dean Lessard, Department of Public Works, regarding the need for additional repairs to be completed by the Town of York.

There are also concerns which still need to be addressed concerning the barking dog issue. President Rainforth has requested the Board conduct a second closed meeting on Wednesday, August 14th.

Under New Business, Sally Hudgins reported because the Health Care contract between York Hospital and Spring Pond Estates was discontinued it will no longer be included as part of the Association’s Welcome Package, but noted services are still available to homeowners on an individual basis.

Treasurer Strazzere also reported that on certain occasions, mail is not being delivered via the 4 Styles Lane new mailing address and that he will notify the Post Office of the problem.

Motion to adjourn by Board Member Strazzere, seconded by Board Member Laughton. Motion Passed.

Town of York Leash Law

The following TOWN OF YORK, ANIMAL CONTROL ORDINANCE: SECTION 4 - CONTROL OF DOGS defines the law which Spring Pond Estates residents must follow:


"When off the premises of the owner, a dog shall be on a leash AND under control of a person responsible for the dog's behavior, except as follows:

1. DOGS AT USE DURING HUNTING

2. DOGS USED FOR LAW ENFORCEMENT
3. SERVICE DOGS
4. DOGS ON PRIVATE PROPERTY WITH THAT PROPERTY OWNER'S PERMISSION TO BE UNLEASHED WHILE WITHIN VOICE CONTROL or
5. DOGS AT PUBLIC BEACHES IN ACCORDANCE WITH SECTION 10

THE OWNER OF ANY DOG FOUND IN VIOLATION OF THE ABOVE PROVISIONS SHALL BE SUBJECT TO THE CIVIL PENALTIES PROVIDED IN THIS ORDINANCE."

July Board Meeting Minutes

Monthly Board Meeting

July 8, 2019


President Rainforth called the meeting to order at 6:25 PM with all Board Members in attendance.

Secretary's Report
Recording Secretary Rotsko’s June minutes were accepted as written. Board Member Sally Hudgins made a motion to accept the minutes, seconded by Vice President Sally LeMon. Motion passed (Recording Secretary minutes on file).

Treasurer's Report
Treasurer Strazzere noted there was an additional item included in his report concerning the HVAC unit at the Community Center in which he explained the York Water District bill was paid in June rather than in July. Board Member Sally Hudgins made a motion to accept the report, seconded by Board Member Jane Laughton (Treasurer report on file)

By-Laws Committee
By Laws Committee Chairperson, Sally Hudgins reported the By Laws Committee will be meeting in September.

Landscaping Committee
Landscaping Committee Chairperson, Sally LeMon noted the June 25th committee meeting was postponed to a later date.  Board Member Jane Laughton reported that the overgrown weeds in her back yard need to be addressed by Patten Landscaping. Lee Page also mentioned the need to maintain the area around the Community Center (Report on file).

Maintenance Committee
Maintenance Committee Chairperson Lee Page reported he is still seeking a permanent solution to the light post problem on Styles Lane. He also discussed his plan to repair the cracks along the complex roadways and the community center parking lot.

Board Member Sally Hudgins reiterated the question that was brought up at the annual meeting concerning a request to resurface an individual driveway. It was suggested at that time by former
Vice President Kaplan that the homeowner submits the request to the Board for approval. Board Member Hudgins was also in agreement to address the Board first (See June 11th Annual minutes under Homeowner’s Input).

Long-Range Planning Committee
Long-Range Planning Chairperson Strazzere noted the July committee meeting report will be
submitted at the next Board meeting in August.

Old Business
Under Old Business, President Rainforth reported Treasurer Strazzere brought to her attention a section of the Town of York Animal Control Ordinance that specifically addressed the dog leash issue which was discussed at the June 21st Special Board Meeting. She noted that a copy of the ordinance will be given to Bob Stewart and will be posted at the Community Center

President Rainforth also reported that she has contacted John Patten concerning the dragon fly
distribution noting that, at this point in time, it does not appear to be helping control the mosquito problem.

New Business
Under New Business, Treasurer Strazzere suggested contacting D. F. Richard regarding the Community Center to see if it would be possible to pay the propane charges in advance thus receiving the ten cents prepay discount. A motion was made by Vice President LeMon, seconded by Board Member Jane Laughton to have Treasurer Strazzere research the possibility and proceed if it would be advantageous to the Association. Motion passed.

There was also some discussion concerning the barking dog issue. It was the consensus of the Board that there did seem to be some improvement. Treasurer Strazzere suggested the subject be revisited at the next Board meeting in August.

Motion to adjourn made by Treasurer Strazzere, seconded by Vice President LeMon. Motion passed. Meeting adjourned at 7:00 PM.

Annual Meeting Minutes

Spring Pond Estates Homeowners Association
Annual Board Meeting

June 11 2019

Prior to opening the meeting President Rainforth announced the passing of our long-time neighbor and friend, Charlotte Sanbourn and asked for a moment of silence in her honor.

The meeting was then called to order at 6:30 PM and President Rainforth welcomed all homeowners in attendance. She also thanked the board members, committee members, chair people and volunteers for their dedicated service throughout the past year. (List of participants on file)

Secretary's Report

Secretary Hudgins reported there were 10 proxy votes and 20 attendees at this evening’s meeting.

Minutes from the June 12, 2017/2018 annual meeting were read. There were no revisions or corrections. A motion was made by Anita Haskell, seconded by Pat Mirisola to accept the minutes. Motion passed. (Secretary’s Minutes on File)

Treasurer's Report

Treasurer Strazzere reviewed the budget for the 2019/2020 Fiscal Year. He requested we establish a long-range oversight committee in order to evaluate what adjustments may be required to maintain the existing budget lines with a five to ten-year time frame in mind. A motion was made by Dolores Corradino to accept the Treasurer’s report, seconded by Lee Page. Motion passed (Treasurer’s Report on File)

ARCHITECTURE COMMITTEE

Chairperson Kaplan reported on a request to have a fence panel installed at 8 Spring Pond Circle along with two fence panels to be installed at 9 Ruch Lane. The SPEHOA approved both requests at the May 13th monthly meeting. (Report on file)

LANDSCAPING COMMITTEE

Chairperson Rainforth reported on the challenges that occurred throughout the year and presented an in-depth report addressing specific issues relating to each of the past four seasons. (Report on file)

MAINTENANCE COMMITTEE

Chairperson Page submitted his annual report detailing numerous repairs and other issues he has addressed throughout the year. (Report on file)

PLOWING

Chairperson Laughton reported there were twelve snow storms this past winter with no blizzards and that the use of a backhoe and bobcat by John Patten were very effective in assisting with the removal of snow mounds and the clearing of homeowner’s driveways. She also thanked Sally Hudgins and Diane Kaplan for their assistance in monitoring snow conditions along Ruch Lane. (Report on file)

SOCIAL

Chairperson Winograd thanked the members of her committee for their help and assistance with the Memorial Day, Labor Day and Holiday events. She also noted the Food Pantry Drive is ongoing and that non-perishable donations can be dropped off at our Community Center. (Report on file)

SUNSHINE CLUB

Chairperson Kaplan reported birthday card acknowledgements continue to be distributed throughout the year.

ELECTION

Reporting for Chairperson Schlapak, Sue Bannister noted there were 33 out of 34 ballots submitted in this year’s election. Newly elected to the Board, Sally LeMon, will serve as Vice President; also, elected to the Board were Sally Hudgins and Joe Strazzere, Treasurer.

OLD BUSINESS

President Rainforth reported the chipmunk issue appears to be in decline.

NEW BUSINESS

President Rainforth reported on the letter she received from D. F. Richard stating for any number of gallons paid in advance of the heating season by July 31, 2019, they will offer a $0.10 per gallon discount bringing the delivered price to $1.75 per gallon. (Letter on file)

It was noted that John Patten will be overseeing the dragonfly distribution in the near future.

Lastly, there were concerns addressed regarding speeding, extended guest parking and dogs without leashes.

HOMEOWNER’S INPUT

Diane Kaplan asked if the walk way along the Styles Lane entrance could be repaired. President Rainforth said inquiries will be made as to whether the town or the association would be responsible.

Bob Milbury inquired about having his driveway sealed at his own expense. Beth Kaplan said his request should be presented to the Board.

Dolores Corradino asked if she could have a ramp installed at her residence. The consensus was
installing a removable ramp would be acceptable.

Lee Page made a motion to adjourn meeting, seconded by Dolores Corradino. Motion passed and meeting was adjourned at 7:05 PM

June Board Meeting Minutes

Spring Pond Estates Homeowners Association
Monthly Board Meeting

June 10, 2019


President Gerry Rainforth called the meeting to order at 6:30 PM with all board members in attendance. It was noted by President Rainforth that the Committee Reports would be reported in detail at the Annual June 11th Meeting.

SECRETARY’S REPORT

Acting Secretary Sally Hudgins asked if there were any questions or revisions regarding the April minutes. A motion was made to accept minutes by Board Member Nancy Winograd, seconded by Vice President Beth Kaplan. Motion passed (report on file).

TREASURER’S REPORT

Treasure Strazzere presented his report. A detailed summary of his report will be reviewed at
the Annual June Meeting.

A motion to accept the Treasurer’s report was made by Board Member Jane Laughton, seconded by Vice President Kaplan. Motion passed (Treasurer’s Report on File).

OLD BUSINESS

President Rainforth noted that the Post Office seems to have finally adjusted their delivery to our new number at 4 Styles Lane address.

She also addressed the chipmunk issue stating the problem has, to date, been improved.

NEW BUSINESS

President Rainforth reported that the new contract with D. F. Richard has been posted.

She also informed the Board that she and Treasurer Strazzere met with York Land Trust representative  Stewardship Director Joe Anderson, regarding our Styles Lane boundary line clarification (Copy of Meeting on File).

President Rainforth stated the dragonfly order has been placed and Patten Landscaping will be in charge of the installation process.

Vice President Beth Kaplan reported the lamp post at 20 Spring Pond Circle was damaged by snow plows and will be repaired by John Patten.

She addressed concerns about dogs not being leashed, obeying the speed limit and limiting visitor parking. President Rainforth noted these issues will be discussed at the annual meeting and notices will be posted (Copy of Posted Notice on File).

Monthly Board Meetings are held in the Community Center on the second Monday of each month at 6:30 PM.

The next meeting is Monday, May 13, 2019.

There are three openings for the Spring Pond Estates Association Board of Directors. Nominations are now closed.

Proscape Irrigation System Startups - Friday, May 3rd



SPRING IS HERE! and Proscape will be here on May 3rd to activate our irrigation systems.

The backflow valve will be checked on all systems where the valve is located within your garage.

Backflow valves located outside may be postponed to a later date, since they are easily accessible.

Proscape will arrive with two trucks - one to start at the Community Center and the other to start work on our personal systems.

If you will not be available on May 3rd, please leave your garage open or ask a neighbor to be available for you. If you miss this appointment, it will be your responsibility to contact Proscape for a new appointment.

April Board Meeting Minutes

Spring Pond Estates Homeonwers Association
Monthly Board Meeting
April 8, 2019

President Rainforth, called the meeting to order. Jane Laughton and Frank
McClellan were absent. All other members present.

Secretary’s Report
Board members were asked if any corrections were noted. Motion to accept was made by Beth Kaplan and seconded by Nancy Winograd. Motion passed (report on file)

Treasurer’s Report
Report was presented to all Board members by Joe Strazzere and each member reviewed. Treasurer Strazzere has discussed the importance of reviewing the long range planning for the SPEHOA and President Rainforth agreed this is an important task to be undertaken.

Motion made by Nancy Winograd and seconded by Beth Kaplan. Motion

Landscaping Report
Chairman Rainforth presented a detailed report which is on file. All arborvitae have been trimmed. Spring clean-up was done in it’s entirety. Sand barrels removed and gas tank “stakes” removed and all reflectors also. (report on file)

Patten Landscaping will return to repair damage to lawns.

Maintenance
Lee Page has affixed the new number (4 Styles Lane) outside the Community Center, replaced some bulbs in the C C. Lee will inspect outside of homes for any damage to siding etc.

Plowing
John Patten’s men did a wonderful job this past winter with plowing, sanding etc. it has been suggested that an additional sand barrel be placed between #8-#10 Ruch Lane to control the ice buildup from the down spout. (report on file)

New Business
President Rainforth has spoken again to Chalmers Insurance to assure all the correct and legal paperwork is in order regarding the changing of the number of the association. Also see on file,
the letter that was sent to the postmaster here in York, regarding the issues we have had with some of the mailboxes No response was received. (letter on file)

Homeowners Input
Sally LeMon questioned the trimming of all trees and arbor vitae that are in the individual homeowners gardens. See Section 6.2 Covenants found under the Maintenance heading. The Board and Landscaping Committee will take under advisement

If you haven't already done so, please remember to send a copy of the first page of your Homeowner's Insurance to Sally Hudgins.

This insurance verification is required each year. Sally will continue to collect them.

March Board Meeting Minutes

SPEHOA MONTHLY BOARD MEETING
MARCH 11, 2019

President Rainforth called the meeting to order. Frank McClellan was absent. All other Board members were present.

Secretary’s report
Board members were asked for any corrections on the November minutes.

Hearing no corrections a motion was made by Nancy Winograd and seconded by Jane Laughton. Motion passed. (Report on file)

Treasurer’s report
Joe Strazzere, Treasurer, who was unable to attend, had presented his report in detail, to President Rainforth and all Board members reviewed this report with no questions.

A motion to accept was made by Beth Kaplan and seconded by Nancy Winograd. Motion passed. (Report on file)

Landscaping and Maintenance reports
President Rainforth gave a detailed overview of these Committee’s with all activities from November through February. These reports are on file.

Lee Page, Maintenance chairman reported that he will be preparing a new sign giving our new address ( 4 Styles Lane) to be properly displayed outside the Community Center.

New Business
President Rainforth explained her meeting with Chalmers Insurance and the issue with the change of address and the necessity of following through with this change. All this documentation is on file. Board members have requested that for legal purposes, the Insurance document should be signed by the representative at Chalmers Insurance.

Sally Hudgins reported that the annual report to the State of Maine is being prepared, also with the change of address for Spring Pond Estates Homeowners Association. A copy of this will be filed with the March board minutes.

Jane Laughton reported that there have been problems with our mailboxes and that the main mail box door had been left open on occasion. There have been some ongoing problems with Mail delivery. President Rainforth will meet with the Postmaster to discuss.
